Terms and Conditions

This agreement applies to the use of the Chiclegs website, mobile application, and mobile site collectively referred to as the "Platform." By using the Platform, you agree to these terms. If you disagree, please stop using the Platform. Make sure to review these terms whenever you visit the Platform.

Eligibility

You confirm that you're at least 18 years old and fully understand and agree to these terms. If you're under 18 or unable to enter into a legal contract, we reserve the right to terminate your membership.

Use of the Platform

You're granted a limited license to use the Platform according to these terms. You must not break any laws or disrupt the Platform. All content on the Platform is owned by Lavprit Foods, and you can't use it without permission.

Product Purchase

Lavprit Foods sells products on the Platform in specific locations only. We reserve the right to limit quantities, reject or discontinue products without notice. Prices and descriptions might change without notice. If there's a variance in the quantity ordered and supplied, we'll adjust charges accordingly.

Delivery and Charges

Delivery charges and taxes may apply. While we try to deliver on time, circumstances might cause delays. We've introduced contact-less delivery due to the ongoing pandemic.

Intellectual Property and User Account

The Chiclegs brand and the Platform belong to Lavprit Foods. We're not responsible for third-party links on the Platform. You're responsible for your account's accuracy and security.

User-Generated Content

Anything you post on the Platform gives Lavprit Foods the right to use it. We don't control user interactions and aren't liable for them. We reserve the right to remove objectionable content at our discretion.

Security and Marketing

You can't reverse engineer the Platform or violate its security. Unless you opt out, you may receive marketing communications from us.

Chiclegs Cash and Cash+

Chiclegs Cash allows you to make purchases on the Platform, while Chiclegs Cash+ is a loyalty program where you can earn rewards.

Disclaimer of Warranties: Using this Platform is at your own risk. Lavprit Foods provides the Platform, Products, and offers "as is" and "as available." Lavprit Foods explicitly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement concerning the Products, Platform, or any reliance on or use of them. Lavprit Foods does not guarantee the accuracy, reliability, completeness, or timeliness of the content and links to third-party platforms on this Platform. Any advice or information obtained from this Platform does not create any express warranties regarding the Products' results or correction of defects.

Limitation of Liability: Lavprit Foods' entire liability and your exclusive remedy, concerning the Platform, Products, offers, or any breach of the Agreement, is solely limited to the amount you paid in the last month, excluding shipping, handling costs, and taxes for purchased Products. Lavprit Foods will not be liable for any direct, indirect, incidental, special, or consequential damages associated with the Agreement, Platform, Products, or offers, including claims related to the inability to use the Platform or Products, procurement of substitute Products, or loss of profits, goodwill, or user information.

Indemnification: You agree to release, indemnify, defend, and hold harmless Lavprit Foods, its contractors, agents, employees, officers, directors, shareholders, affiliates, and assigns from liabilities, claims, damages, costs, and expenses arising from your violation of the Agreement, use of the Platform or Products, infringement of intellectual property rights, or information supplied to Lavprit Foods. Lavprit Foods may seek assurances for indemnification when threatened or sued by a third party. This provision remains effective even after termination of the Agreement.

Modification: Lavprit Foods reserves the right to amend the Agreement at any time by posting amendments on the Platform. Your continued use of the Platform after any such amendments constitutes acceptance of the Agreement, including the amendments.

Privacy: Lavprit Foods prioritizes user privacy and refers users to its Privacy Policy for details on data use.

Cessation of Operation: At its sole discretion and without prior notice, Lavprit Foods reserves the right to cease the operation of the Platform, the distribution of Products, or any offers on the Platform.

Entire Agreement: This Agreement, along with referenced policies and guidelines, constitutes the complete understanding between you and Lavprit Foods, superseding any previous agreements on the subject matter.

Effect of Waiver: Lavprit Foods' failure to enforce any provision of this Agreement does not waive its rights to do so. If any part of this Agreement is found invalid, the intent of the parties in that provision should be honored, with all other provisions remaining valid.

Governing Law and Jurisdiction: This Agreement is governed by Indian law and falls under the exclusive jurisdiction of courts in Bangalore, Karnataka.

Dispute Resolution: Any disputes between you and Lavprit Foods will be referred to a sole arbitrator appointed by an impartial third-party arbitral institution identified by Lavprit Foods. Arbitration will be held in Bengaluru, Karnataka, conducted in English under the Arbitration & Conciliation Act, 1996. This arbitration agreement remains in effect even after the Agreement terminates.

Waiver of Class Action Rights: By agreeing to this contract, you relinquish any rights to group claims through a class action or similar mechanism. Claims related to this agreement must be brought forward individually.

Termination: Lavprit Foods holds the right to terminate your Platform access without prior notice if it reasonably believes you've breached any terms. Post-termination, you'll be denied access, and Lavprit Foods might cancel outstanding Product orders without advance notice. This Agreement continues indefinitely unless Lavprit Foods chooses, without notice, to terminate it.

Use of Platform outside Operating Locations: Lavprit Foods does not assert that the Platform, Products, or offers are suitable or available for use beyond designated Operating Locations.

Assignment: You're restricted from assigning your rights and obligations under this Agreement to others. However, Lavprit Foods may, in its sole discretion and in accordance with applicable law, assign its rights and obligations without prior notice.

Severability: Should any part of this Agreement be deemed unlawful or unenforceable, the remaining provisions remain in full force, adhering to the fullest extent permitted by law.

Conflict: In case of discrepancies between this Agreement and other referenced policies or guidelines on the Platform, this Agreement's terms supersede regarding the subject matter herein.
